You may use the website only for lawful, personal, and noncommercial purposes. You agree not to:
- Use the website in violation of applicable laws or regulations;
- Attempt to gain unauthorized access to the website or related systems;
- Interfere with the operation, security, or availability of the website;
- Introduce viruses, malicious code, or other harmful technology;
- Scrape, reproduce, or commercially exploit website content without permission;
- Impersonate another person or provide false information; or
- Use the website for fraudulent, abusive, or unlawful activity.
We may restrict or terminate access to the website if we reasonably believe these Terms have been violated.
3. Website Information
We make reasonable efforts to keep website information accurate and current. However, festival dates, operating hours, schedules, attractions, performers, vendors, prices, policies, and availability may change without notice.
Information displayed on the website does not guarantee that a particular attraction, activity, product, vendor, performer, or service will be available during your visit.
4. Tickets and Online Purchases
Tickets may be sold through the website or a third-party ticketing provider. Purchases may also be subject to the provider’s terms, privacy policy, processing fees, and other conditions.
By purchasing a ticket, you agree that:
- You are authorized to use the payment method provided;
- The information submitted during checkout is accurate and complete;
- Applicable ticket prices, taxes, and processing fees will be disclosed during checkout;
- Tickets may be valid only for the event, date, admission type, or period identified at purchase;
- Tickets may not be duplicated, counterfeited, or resold for commercial purposes without written authorization; and
- Lost, stolen, damaged, or duplicated tickets may not be replaced.
We may cancel an order resulting from a pricing error, technical problem, suspected fraud, unauthorized resale, or other circumstances reasonably requiring cancellation.
If we cancel a valid paid order, the amount paid directly to us will be refunded, subject to any separate third-party processing policies.
5. Refunds, Weather, and Schedule Changes
Unless expressly stated otherwise at the time of purchase, all ticket sales are final and nonrefundable. Refunds will not be issued because of rain, inclement weather, changing weather conditions, or a visitor’s inability to attend.
The Great Pumpkin Farm is an outdoor, seasonal venue. Weather, ground conditions, maintenance, staffing, safety concerns, attendance levels, and other circumstances may affect the operation or availability of attractions, rides, entertainment, vendors, and activities.
We may delay, modify, relocate, suspend, or cancel an attraction, performance, activity, or portion of an event when reasonably necessary. These changes do not automatically entitle ticket holders to a refund.
If The Great Pumpkin Farm cancels an entire separately ticketed event, refund or exchange information, if applicable, will be communicated to affected ticket holders. Third-party processing fees may remain nonrefundable.
6. Admission and Attractions
Admission does not necessarily include every ride, attraction, game, food item, beverage, product, or activity available on the property. Certain attractions and services may require an additional ticket, fee, reservation, waiver, or separate purchase.
Attraction availability and participation requirements may vary. Visitors must follow all posted rules and staff instructions, including requirements related to age, height, weight, health, footwear, clothing, supervision, and conduct.
The Great Pumpkin Farm and its attraction operators may refuse participation when reasonably necessary for safety, security, operational, or legal reasons.
7. Assumption of Risk
Visiting a working farm and participating in festivals, rides, attractions, hayrides, corn mazes, play areas, animal encounters, contests, and outdoor activities involve inherent risks.
These risks may include uneven or slippery surfaces, changing weather, crowds, farm equipment, animals, insects, allergens, loud noises, moving vehicles, physical exertion, and risks associated with rides and recreational activities.
By entering the property or voluntarily participating in an activity, visitors acknowledge and accept the ordinary and inherent risks associated with that visit or activity.
Visitors are responsible for determining whether they and any minors under their supervision can safely participate. Nothing in these Terms waives any right or liability that cannot lawfully be waived.
8. Minors and Parental Supervision
Children and minors must be supervised by a responsible parent or guardian. Parents and guardians are responsible for deciding whether an attraction or activity is appropriate for a child and for ensuring compliance with all posted requirements.
Certain events and activities may establish additional age restrictions or require minors to be accompanied by a parent or legal guardian.
9. Visitor Conduct
Visitors must behave safely and respectfully toward employees, contractors, performers, vendors, animals, and other guests. Prohibited conduct includes:
- Threatening, abusive, disruptive, disorderly, or unsafe behavior;
- Harassment or discrimination;
- Entering restricted, staff-only, or closed areas;
- Damaging, stealing, or misusing property;
- Interfering with animals, equipment, attractions, or operations;
- Possessing unlawful drugs, weapons, or other prohibited items;
- Using counterfeit, altered, duplicated, or unauthorized tickets; and
- Failing to follow posted rules or reasonable staff instructions.
We may refuse admission or remove a visitor who violates these rules or presents a safety, security, or operational concern. Unless required by law, removal for prohibited conduct will not entitle the visitor to a refund.
10. Alcoholic Beverages
Alcoholic beverages may be sold only to individuals who are at least 21 years old and present valid government-issued identification.
We may refuse alcohol service to anyone who cannot provide acceptable identification, appears intoxicated, or may otherwise be refused service under applicable law.
Visitors must consume alcoholic beverages responsibly and only in permitted areas. Alcohol may not be provided to minors.
11. Contests and Promotions
Contests, giveaways, promotions, and special events may be governed by additional official rules. If additional rules conflict with these Terms, the specific rules for that contest or promotion will control.
Participation does not guarantee a prize. We may disqualify entries that are incomplete, fraudulent, unlawful, inappropriate, or submitted in violation of the applicable rules.
12. Group Events and Reservations
School tours, birthday parties, corporate activities, private gatherings, and other group events may require advance reservations, deposits, signed agreements, minimum attendance, or additional terms.
Cancellation, rescheduling, payment, and refund policies applicable to a group reservation will be provided during booking or in the applicable reservation agreement.
13. Photography and Recording
Guests may take photographs and personal recordings for private, noncommercial use, provided they do not interfere with operations, violate another person’s privacy, enter restricted areas, or create a safety concern.
Commercial photography, professional productions, advertising shoots, and drone operations require prior written permission from The Great Pumpkin Farm.
The Great Pumpkin Farm may photograph or record public areas of the property for security, documentation, advertising, and promotional purposes, subject to applicable law.
14. User Submissions
If you submit photographs, contest entries, testimonials, reviews, comments, suggestions, or other material, you represent that you have the right to submit the material and that it does not infringe another person’s rights.
Unless separate contest rules or a written agreement state otherwise, you grant The Great Pumpkin Farm a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share voluntarily submitted material in connection with our operations, website, advertising, and promotional activities.
You retain ownership of your original material. Do not submit confidential information through a public contest, review, or social media channel.
15. Intellectual Property
The website and its text, graphics, logos, photographs, videos, designs, and other content are owned by or licensed to The Great Pumpkin Farm and protected by applicable intellectual-property laws.
You may view and print website content for personal, noncommercial use. You may not reproduce, modify, distribute, sell, republish, or commercially exploit website content without prior written permission.
16. Third-Party Websites and Services
The website may link to ticket processors, payment providers, social media platforms, sponsors, vendors, maps, and other third-party services.
These third parties operate independently and maintain their own terms and privacy practices. We are not responsible for the availability, security, content, products, services, or practices of third-party websites.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be available, uninterrupted, secure, error-free, or free from harmful components.
We do not guarantee the completeness or accuracy of information provided by third parties, including vendors, sponsors, performers, attraction operators, or ticket processors.
18. Limitation of Liability
To the fullest extent permitted by law, The Great Pumpkin Farm and its owners, employees, representatives, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the website.
For claims arising solely from an online purchase, our total liability will not exceed the amount paid directly for the product or ticket giving rise to the claim.
These limitations do not apply where liability cannot be limited or excluded under applicable law.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The Great Pumpkin Farm and its owners, employees, representatives, and contractors from claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or fraudulent conduct.
20. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last updated” date.
Your continued use of the website after an update constitutes acceptance of the revised Terms. Terms applicable to a completed purchase will generally be those presented or in effect when the purchase was made, unless a change is required by law.
21. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or the website shall be brought in a court of competent jurisdiction located in Erie County, New York, unless applicable law requires otherwise.
22. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will remain in effect.
